NOTICE OF AN APPLICATION FOR DISCHARGE WHOLLY OF RESTRICTIVE COVENANTS
TAKE
NOTICE that an Application for Discharge (wholly) of restrictive
covenants imposed by an Indenture dated 17th
August, 1857 between W. Reit. W. Shone and T.
Wood and an Indenture dated12th January,
1870 between the same parties affecting
the property known
as land ON THE SOUTH
WESTERLY SIDE OF UPTON
PARK, CHESTER shown edged red on the plan annexed thereto has been made to the Land tribunal
pursuant to Section 84 of the
Law of Property Act 1925 as amended by the Law of Property Act,1969 by John
Arthur Williams of Victoria House, 26 Tilehouse Street.

A copy of the application, plan of the land and details of the instruments imposing the restriction dated
17th August. 1857 and 12th January, 1870 may be inspected at the office of
the Applicant's Solicitors, Messrs. Ross Williams Wakefield and Company of Victoria House. 26 Tjlehouse Street, Hitchin. Hertfordshire on any
weekday except Saturday between the hours of 9.30 a.m. and 5.30p.m.
The restrictions affecting the above property as follows:
1. "Not any time to erect or build more than one villa but which might be either single or double upon each of the said several plots of land conveyed and that such villa is single should be not of less annual value than £15 and if double than £24".
2. '' Not at any time to erect or build more than one double villa or two separate or single villas on any of the said plots of land and that such villa or villas if erected should be built in accordance with the plan approved of by the said W. Reit, W. Shone and T.Wood or the surveyor or agent," etc.
The grounds of the Application fall within paragraphs (a) and (c) of subsection 1 of Section 84 of the Law of Property Act, 1925, namely:
(a) That by reason of changes in the character of the property or the
neighbourhood where the circumstances of the case which the
Lands Tribunal may deem material the restriction ought to be
deemed obsolete and
(c) That the proposed discharge or modification wiH
not injure the
persons entitled to the benefit
of the restriction.
Any person claiming to be LEGALLY ENTITLED
TO THE BENEFIT OF the RESTRICTIONS
and who wishes to object to the dis-charge wholly thereof or claim compensation in
respect of the same is required to send a
Notice of
Objection including quantification of compensation
if claimed to the Registrar of the Lands Tribunal. 48-49
Chancery Lane, London WC2A 1JR and to the
Applicant's Solicitor
WITHIN 28 DAYS OF THE DATE OF THIS NOTICE on forms
which will be supplied by the Registrar of
the Lands
Tribunal on request.
